Terms and Conditions

Before applying, makers and performers must read through, understand and sign their application to show they agree to our Terms and Conditions. Your submission of this application acknowledging these terms are required for participation. By applying you are confirming you agree with our terms and conditions, which have been put together to protect your business, Constitution Hill, and our visitors.

Application Criteria

Your products need to meet the following criteria:

  • Small Business – we support small businesses with owner-made items 
  • Local – proudly South African in concept and creation. Whilst products might contain imported components, they must be conceived and hand-finished locally. 
  • Original – unique, original and innovative in design – no replicas or fake products
  • Duplication – We will avoid too much of one product at multiple stalls.
  • Capacity – Your capacity to produce and deliver.
  • Quality – showcasing quality products

Application

Makers may only apply as one company per application and must exhibit products/services as represented in the application submitted. Applications do not guarantee acceptance into the market. Exclusivity is not guaranteed to any one maker, but precautions will be taken to limit duplication of similar items and spacing out makers with similar products.

Shared Stalls

You may share a 3 m x 3 m stand space with another vendor, though both traders must apply separately to the market. If both are accepted, you would only submit one vendor fee for the space when fees are due. Vendor fees cannot be split! CMM is not responsible for pairing up traders and does not allow traders to apply for half of the stand space.

Before the Event
  • Prior to the event, you will be sent set-up instructions and layout.
  • Each market has its own set of logistics. You will be sent a full folder of information and social media posts at least two weeks before a market and after you have paid for your booth. 
  • Space assignments are released by the Monday before the market. 
  • It is advisable to connect with our social media channels and take advantage of our strong social media following. Please keep our team aware of any new social media handles you are using.
  • The office team are responsible for the allocation and position of stalls, and it is not permissible for stallholders to change their stall position on the day.
  • Any queries need to be made to our team during office hours.
  • The Curated Makers Market reserve the right to change stall locations.
  • When applying for a market we need you to provide the Curated Makers Market office team a description of what you intend to sell.
  • We will discuss with you want can be sold at a particular event and any additions/amendments need to be approved by the Curated Makers Market office team.
  • Any additional items not agreed upon may be asked to be removed on market day.
  • We are unable to offer any of our stall holders exclusivity.
On the Day
  • Our markets normally open for makers to start setting up 3 hours before a market.  We expect all makers to be fully set up and in place 30 minutes before the market opening.
  • You will be given set-up instructions and a layout prior to the event. It gives you information such as off-loading times, event times, car parking, etc.
  • When setting up, closing down, loading and unloading, care should be taken for your own safety and the safety of others.
  • Where traffic management cones and signs are in place, it is the responsibility of all stallholders to ensure that they are correctly repositioned if moved for access.
  • Should a stallholder need to leave an event early it is expected they will first gain permission from the event manager.
  • Stallholders must operate strictly within the boundaries of the stall, which in most instances is 3 m x 3 m and any additional tables must fit within the allocated space. Please be considerate to your market neighbours.
  • The presentation of stalls should be professional. A well-presented stall will aid your sales.
  • We aim for us all to work in a supportive and respectful environment. We should treat our event managers, stallholders, and members of the public with courtesy and respect at all times.
  • Instructions given by our infrastructure team or event management regarding risk management or accident prevention must be complied with strictly and immediately.
  • Please ensure nothing sharp or dangerous is attached to tables or gazebos that could endanger or harm set up crew when erecting or dismantling equipment or damaging infrastructure.
  • Smoking is not permitted in the vicinity of the stalls.
  • When leaving the event stall holders must remove and take away their own trade waste and ensure the stall area in the same condition that it was in before they set up their stall that day.
  • Any offensive artwork should be censored by stickers, blur effects, etc. We are a family-friendly event and don’t expect traders to openly advertise profanities on the stall. We will ask traders on the day to cover this up if not done beforehand.
Food Traders
  • No handling food without gloves
  • Hand wash facilities must be provided (as a minimum flask of hot water and hand wash)
  • ALL open food must be covered
  • Spray and wipe the table before and after use with an anti-bacterial spray
  • You must clear your own rubbish at the end of the day, it is not to be placed into our bins.
  • Each food-based business needs to register with COJ. Curated Makers has the right to request an inspection from an environmental health officer. At each event, you must produce your COA for spot checks.
  • It is your responsibility to ensure all your accreditation is up to date.
  • We need you to think over the risks of showcasing at our events and plan a risk assessment. Plan out what you have to do to keep yourself and our visitors safe. Thinking of trip hazards, sharp objects, health and hygiene hazards, and infrastructure hazards (especially when you provide your own gazebo, weights, etc).
  • Power is provided at a cost of R 150 for our events and must be applied for in your application. 
  • All gas appliances must have gas safety certification. Do not bring more than one gas bottle onto the site.
Additionally for Alcohol Traders
  • You must have a license to sell alcohol at the events. You need to supply us with your personal license number.
  • If the personal license holder is unable to work the stall you must ensure you designate a competent number of staff who understands the responsibilities of your personal license.
  • No tasters are to be displayed on your stall and should not be given until asked for by a potential customer.
Payments
  • All payments are to be made online via our website, once the payment has gone through you’ll receive an email confirming the booking.
  • We are unable to take any cash payments.
  • Once confirmed if you need to cancel the event we need you to let us know by 4 pm the Monday prior to the event.
  • A refund or market credit can be issued only if you cancel before 4 pm on Monday before the event takes place
  • After this time we can only issue market credit if a replacement is found and no refund will be given.
  • Please let us know ASAP if you are unable to attend an event, an empty stall is detrimental to the event and to your fellow stallholders.
What is the CMM Cancellation Policy
  • Our Curated Makers Market events take place throughout the year in all weather. On the rare occurrences that we do cancel an event, The Curated Makers Market will offer a credit refund on the stall fee for future events. We will give you our stall holders as much notice as we can and promote the cancellation on our social media.
  • Once a maker is accepted into a market, we only issue credits under exceptional circumstances. This includes unforeseeable events including but not limited to pandemic outbreaks, new regulations prohibiting gatherings, Maker (or your staff) contracting COVID-19, government regulations, or other weather-related events. In case you have to cancel or simply cannot attend please email bandile@conhill.org.za as soon as possible. Day-of cancellations and no-shows without any communication will affect future acceptances.
Disputes
  • We need to ensure we all work together in a respectful environment. Any disagreements between stall holders or concerns need to be addressed to the office team Monday-Friday during office hours. We employ event managers on the weekends who do not decide on layouts etc. Our event manager’s role on market day is to ensure the event is safe, managed, and marketed. 
  • Any unacceptable behaviour including aggression, abusive language or refusal to comply with a reasonable direction will be treated as a breach of these conditions. Such a breach is likely to result in that stallholder being required to leave the markets immediately and being banned from trading at any future markets.
  • Issues regarding copyright must be dealt with between the traders, we are a platform to trade from and will not get involved in the legalities of sorting any infringement or copyright issues.
  • Any stallholder using equipment or practices that could endanger the health & safety of any persons will be asked to leave the event.
Own Infrastructure

Stallholders supplying their own infrastructure must ensure that it is fit for purpose and weighted appropriately. The Curated Makers Market is not liable for any damages caused by your own infrastructure. 

Sustainability

We strive to eventually be completely plastic-free and encourage traders to use eco-friendly sustainable packaging. 

Traders take responsibility for cleaning their own stall space and are required to remove all excessive rubbish from the Market. Rubbish bins provided are for the general public and not to be used to dispose of stall holders, food truck waste and or packaging. Should your stall not be spotless when you leave an R 150 cleaning fee will be added to your invoice for the next market.

Liability & Damages

Makers will be provided with an empty space and must provide their own extension cords, display equipment, etc. You are responsible for any damages caused by your company to the market, attendees, or other makers. If you supply your own tent it must fit in the space provided and be able to withstand inclement weather. It is the Maker’s responsibility to ensure that tents will never become a threat to other Makers or attendees. Makers are fully responsible for their own personal property. Neither Curated Makers nor Constitution Hill will assume liability for any losses that you may incur including overnight stays of the market.

Security

Traders are responsible for the security of their booth space and products. Traders cannot hold Curated Craft Market or the hosting location responsible for theft, damage, or injury. Stallholders are responsible for their own stall security and monies. No responsibility is taken by The Market Folk for theft, loss or damage.

Inclement Weather

Curated Makers may adjust the hours of the market due to forces of nature or other occurrences beyond our control in the name of safety. Such changes will not be considered a breach of agreement, and makers will receive a credit. As organisers, we take just as big a risk as traders, as we have expenses beforehand in terms of infrastructure, entertainers, venue, JOC, marketing etc. If you do not agree with this policy please do not apply

Applicable Laws and Regulations

Approved applicants are solely responsible for maintaining their compliance with relevant government regulations, codes, licenses, insurance, and taxes.

Prohibited Items

The sale of firearms, weapons obscene materials, and illegal paraphernalia is forbidden. Any exceptions must be taken up with our team in writing. 

Photography Notice

CCM staff (or in some cases, a professional photographer) will be taking photos and/or video including sound during the events. These photos may include you and your products. These will be used on our website, social media, and in the promotion of events by the Curated Makers Market, Constitution Hill, its affiliates, and other advertising entities.

Live Music

Please note that CCM may have live musicians playing at our events! Some booth spaces may be in closer proximity than others to the musician(s). Booth placements are made on a first come, first serve basis and based on artisan requests. If you have any concerns, please note them in the comment box on the application. We will do our best to make accommodations, but we cannot guarantee your placement in relation to the musician(s) or make changes once the layout is confirmed.

Rights

Curated Makers Market has the right to move, remove, or limit the participation of any applicant at any time for any reason. Under no circumstances will Constitution Hill or the Curated Makers Market be liable for any of the following losses or damage (whether such losses were foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of Artisans Online regardless of the form of action.

Changes to the Service

Constitution Hill and the Curated Makers Market retain the right to terminate or change the service for any reason at any time without notice. We will inform registered users by email of any changes to the Terms of Use. We retain the right to refuse service to anyone at any time and to terminate accounts if in breach of the Terms of Use

COVID-19 Safety Acknowledgement

You are acknowledging that you understand the contagious nature of COVID-19 and its variants that can lead to severe illness and death and that any public place has an inherent risk of exposure. You understand that Curated Makers Market cannot guarantee that you will not be exposed. Curated Makers Market will follow local COVID-required guidelines and laws, which may change at any time. Makers are required to follow these laws or will be asked to leave without a refund. You are responsible for following any protocols you feel will reduce your exposure to COVID-19. By participating in Curated Makers Market, you voluntarily assume all risks related to exposure to COVID-19. You understand that the risk of becoming exposed to and/or infected by COVID-19 may result from the actions, omissions, or negligence of yourself and others, including, but not limited to, Curated Makers Market staff, makers, and attendees.

Trader Expectations

Throughout the process of booking to attend our events, we have a number of expectations from you the trader, more information can be read below on this.

  • ABUSIVE PHYSICAL BEHAVIOUR
    Under no circumstances do we accept any abusive physical behaviour. Physical abuse will result in termination from our markets. If abusive behaviour is witnessed, reported or known to have taken place there will be an investigation into the situation which will result in action being taken against the perpetrator. The initial response will be to remove them from the next event whilst the investigation takes place.
  • LATENESS
    Whilst we accept lateness is on occasion out of your control repeated lateness is unacceptable due to the effect on the surrounding traders and the market as a whole. If you have been late three times you will, unfortunately, have to be removed from the event. If lateness does take place you will receive a warning from the Makers team via email.
  • NO SHOW
    In the event that you cannot attend, and it is out of office working hours, it is your job to let the event manager know. Like lateness, we accept sometimes things happen that would result in you not being able to attend. However, not communicating your lack of attendance and or not showing up three times within a year will result in you being removed from the event. Event manager’s numbers are included within set up and we expect that any issues over the weekend at markets would be highlighted via a phone call or message.
  • LEAVING THE MARKET
    We expect all traders in most cases to stay for the duration of the event. If traders sell out they may leave, but a note must be left on the table and the event manager must be made aware. The event manager will confirm with you whether it is okay for you to leave early.
  • ON THE STALL
    We of course expect professionalism at all times when trading at our events. Smoking is strictly prohibited around, next to, and in front of the stalls. If you need to smoke we advise walking outside the market event area.
  • STALL SAFETY
    We expect all stall holders to ensure their stall is set up safely. It is essential that all walkways are clear, nothing that is hanging could cause harm and that the products are stacked securely. We have the right to ask you to remove products should they be deemed unsafe.
  • STALL SET UP
    We expect all stalls to be set up to a high standard. If you are new to trading ask for our advice or speak to fellow traders – we are happy to give guidance. The Curated Makers Market POPIA Statement

Curated Makers Market follow all POPIA protocol regarding personal and business data. We do share trader business names when marketing events through social media, print publications and websites.

On occasion, we are asked for information regarding JOC registration from the appropriate authorities and it is within our mandate to respond and disclose this information.

The data entered when filling out your information form will stay within our system until you request for it to be removed. Without your direct communication, we are unaware that you wish to cease trading at our events.
